Welcome to The Extraordinary Adventurer (“we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your use of extraordinary-adventurer.com and our monthly printed adventure mailer subscription (together, the “Service”). By visiting the site, subscribing, or taking part in any challenge, you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 18 years old to subscribe. If a minor takes part in any challenge, a parent or legal guardian must supervise, must accept these Terms on the minor’s behalf, and is fully responsible for the minor’s safety and conduct.
2. What We Provide
Each month we send a printed mailer containing adventure challenges, briefings, stories, and related content. All content is provided for entertainment and inspiration only. It is not professional, medical, safety, legal, or survival advice.
3. Assumption of Risk
Outdoor and adventure activities are inherently dangerous. Hiking, climbing, biking, skiing, paddling, camping, hunting, exploring, and similar activities can result in serious injury, illness, permanent disability, property damage, or death. Risks include, without limitation, falls, drowning, exposure and extreme weather, difficult or unmarked terrain, wildlife, getting lost, equipment failure, vehicle accidents, and the actions of other people.
By taking part in any challenge, you acknowledge and agree that:
- You do so entirely voluntarily and at your own risk. Every challenge is optional.
- Challenges are suggestions, not instructions. You alone decide whether, where, when, and how to attempt one, based on your own skill, fitness, experience, and the conditions on the day.
- You are responsible for checking weather and conditions, following all laws and land-use rules, obtaining any permits or permission, respecting private property, using appropriate safety gear, and telling someone your plans.
- You will never trespass, break the law, or do anything unsafe to complete a challenge. If a challenge is unsafe for you, skip it or modify it.
- We do not supervise, guide, inspect, or control any location, route, or activity, and we cannot guarantee that any challenge, place, or piece of gear is safe or suitable for you.
- Any gear, product, or service mentioned in the mailer or on the site is shared as information, not a guarantee of quality, safety, or fitness for your purpose.
4. Release of Liability
To the fullest extent permitted by law, you (and anyone participating with you or on your behalf) release, waive, and forever discharge The Extraordinary Adventurer, its owner, family members, employees, contractors, and affiliates from any and all claims, demands, losses, damages, and liabilities of any kind, including for injury, illness, death, or loss of or damage to property, arising out of or related to your use of the Service or your participation in any challenge, including those caused by ordinary negligence. This release does not apply to the extent the law does not allow such a release, including for gross negligence or willful misconduct where the law prohibits waiving it.
5. Subscriptions and Billing
The monthly plan is currently $12.99 per month, plus any applicable taxes. By subscribing, you authorize us (through our payment processor, Stripe) to charge your payment method every month until you cancel. Your subscription renews automatically each month. We may change our prices with reasonable advance notice, and the new price will apply from your next billing cycle.
6. Cancellation
You may cancel at any time from the Manage Subscription page. Cancelling stops future charges. You will keep your subscription through the end of the billing period you have already paid for. Cancellation does not entitle you to a refund of any amount already paid.
7. No Refunds
All payments are final and non-refundable. We do not issue refunds, prorated refunds, or credits, including for partial months, unused or unopened mailers, challenges you did not complete, or a change of mind. Any refund we may choose to provide in a particular case is at our sole discretion and is never guaranteed. Nothing in this section limits any rights you have under applicable law that cannot be waived.
8. Shipping
We currently ship within the United States. You are responsible for providing a complete and accurate shipping address and for keeping it up to date. We typically assemble and ship each month’s mailer around the 15th of the month. Delivery times depend on the postal carrier, and we are not responsible for delays, or for mail that is lost, stolen, or damaged in transit, or that is misdelivered because of an incorrect address.
9. Content You Submit
If you send us a story, review, application, photo, or other material (“Submissions”), you confirm that you own it or have the right to share it, and that anyone identifiable in it has agreed to its use. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, and display your Submissions, including your name, city, and photos, in the mailer, on our website, and in our marketing and social media. Submitting an application does not guarantee that you will be featured. You may ask us to remove your Submissions from future use by contacting us.
10. Acceptable Use and Intellectual Property
You agree not to misuse the site, attempt to disrupt or gain unauthorized access to it, or submit anything unlawful, hateful, or infringing. All content, designs, logos, and text of the Service belong to The Extraordinary Adventurer and may not be copied, resold, or reproduced without our written permission, other than for your personal, non-commercial use.
11. Disclaimer of Warranties
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, safety, accuracy, or non-infringement. We do not guarantee that the site will be uninterrupted or error-free.
12. Limitation of Liability
To the fullest extent permitted by law, The Extraordinary Adventurer and its owner, family members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Service or participation in any challenge. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three (3) months before the event giving rise to the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless The Extraordinary Adventurer, its owner, family members, employees, and contractors from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your participation in any challenge, your Submissions, your breach of these Terms, or your violation of any law or the rights of any other person.
14. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Utah, and you consent to their jurisdiction.
15. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date above shows when they last changed. If you keep using the Service after an update, you accept the revised Terms.
16. Severability
If any part of these Terms is found to be unenforceable, the rest will remain in effect.
